When I read this legislation I had serious concerns. So, I followed up with State legislators and got a legal opinion.
We all agreed we didn't like this legislation.
Think of the example of a mixed use condominium complex where the President of the Board of Directors, via his Board, is exempt for the county or municipal government controls, ordinances, etc. of the entity that created it, except for fire and safety services. It appoints its own boards, determines its own standards, infrastructure, etc.
In essence it creates an entity more powerful than a government with less constraints. Like the old Development Authority's actions that built this Tennis Center on its own, but now creating a whole neighborhood or even a town and only answering to itself.
The only way to end the actions of an IDD is to dissolve it. But to dissolve opens the potential of vested interest rights lawsuits.
This is very bad legislation in my mind and I will vote against it.
